Can You Lodge 820 Just Because You Are in Australia? Understand 820 vs 309 Before Choosing a Partner Visa

“Our relationship is genuine and we have all documents ready. I’m currently in Australia, so can I simply lodge a Subclass 820 visa application?” This is a common question when preparing for a partner visa. Before clicking “submit”, one critical point must be verified: whether your current visa conditions allow you to validly lodge an application while onshore in Australia. A genuine relationship forms the cornerstone of any partner visa application. Meanwhile, your application location, existing visa conditions, and residence arrangements during the waiting period will also shape your visa pathway. Today we break down the differences between 820 and 309, plus commonly confused topics including condition 8503, bridging visas, work rights and Medicare.

  1. What are the 820 and 309 pathways respectively?

There are two main partner visa pathways for Australia:

Visa PathwayTemporary StagePermanent StagesApplicant Location at Lodgement
Onshore Partner Visa820801Inside Australia
Offshore Partner Visa309100Outside Australia

Both pathways are generally lodged as a combined temporary and permanent application and assessed in accordance with legislative requirements. 820 and 309 are the temporary visa stages, while 801 and 100 are their corresponding permanent residence visas. Your physical location is only the starting point; you cannot decide your entire application strategy solely based on where you are. This is especially important for those who enter Australia on a 600 tourist visa. You need to further check: does your visa contain restrictions preventing onshore applications? Until what date are you permitted to stay? Are there any prior visa refusals, cancellations or other complex immigration history?

  • If you entered Australia on a Subclass 600 Tourist Visa, first check for condition 8503. Open your grant letter or VEVO record and check whether your visa includes: **8503 — No Further Stay**

This condition prevents the visa holder from applying for many other temporary or permanent visas while remaining in Australia. For applicants wishing to lodge 820 onshore, if condition 8503 applies, you will normally need to obtain a waiver before you can lodge a valid application. Not every 600 tourist visa carries condition 8503, so you must review your individual visa documents. Equally, the absence of 8503 does not mean you automatically satisfy all requirements for 820. Your current visa status, other restrictions and immigration history all need to be assessed together. If your visa has other No Further Stay conditions such as 8534 or 8535, their specific rules must also be reviewed separately.

  • If I have condition 8503, can I get a waiver after getting married?

Marriage alone is generally not sufficient to obtain a waiver of condition 8503. Waivers are usually granted only for compelling and compassionate circumstances that arise after your visa was granted, are beyond your control, and result in a substantial change to your situation. Therefore, arguments such as “we are already married”, “we do not want a long-distance relationship” or “all documents are ready” do not automatically meet waiver criteria. Supporting evidence for your unique circumstances must be provided and assessed by the Department of Home Affairs.

Two key distinctions to note:

  • Submitting a waiver request does not mean the waiver has been approved.
  • Lodging a waiver application will not extend the expiry date of your current visa.

If your visa is about to expire, you must arrange lawful residence concurrently and cannot simply wait for the waiver outcome.

  • After lodging 820 onshore, can I start working immediately?

For eligible applicants who validly lodge the combined 820/801 application, bridging visa arrangements will generally apply to maintain lawful stay once your current visa expires. Three timelines need to be clearly distinguished: application lodgement, bridging visa grant, and bridging visa commencement. For example, if you hold a 600 tourist visa, even if you have received a bridging visa approval notice, the bridging visa will not take effect until your 600 ceases. You must continue complying with the conditions of your current 600 visa. If your existing visa has no work rights, you cannot commence work early merely because “the 820 application has been submitted”. Your work eligibility is determined by the visa currently in force and its conditions. Confirm details via your bridging visa grant letter and VEVO record. You should also account for this time lag in your personal budget and avoid counting unapproved work rights as available income.

  • Can I travel back to my home country or leave Australia while waiting for 820?

Travel is possible, but you must confirm your eligibility to re-enter Australia beforehand. If you are staying in Australia under a Bridging Visa A (BVA), a BVA does not grant the right to re-enter after departing. If you plan to travel overseas and return during the processing period, you normally need to apply for and be granted a Bridging Visa B (BVB) before leaving, and return within the approved travel period. If your original substantive visa remains valid, your entry and exit plans also depend on that visa’s number of entries, expiry date and stay conditions. Therefore, before booking flights, confirm: what visa will you hold on the day of departure? What visa will allow you to re-enter Australia? A pending visa application cannot be used as proof of re-entry rights.

  • If I lodge 309 offshore, do I have to remain outside Australia for the whole waiting period?

Not necessarily. The 309 visa requires lodgement while you are outside Australia. Under current policy, when a decision is made on the 309 application, the applicant may be either inside or outside Australia. While waiting, if you obtain another valid visa, you may travel to Australia to visit your partner under that visa’s terms. One extremely important caveat: after lodging the offshore 309/100 application, entering Australia on a tourist visa will not automatically grant you a bridging visa. Similarly, pending 309 applications do not come with automatic work rights before grant. If your 600 tourist visa for entry prohibits work, you cannot work. If your permitted stay period is expiring, you cannot remain in Australia solely because your 309 application is under review. The idea that “offshore applicants may visit Australia” is completely different from “you can stay indefinitely in Australia and work freely”.

  • Can applicants for 820 or 309 apply for Medicare during the waiting period?

Medicare eligibility is assessed separately and does not depend purely on holding a bridging visa.

People residing in Australia who have applied for permanent residence may be eligible to enrol in Medicare before permanent residency is granted, subject to relevant criteria.

Services Australia requires proof of identity, residence and permanent residence application. Where your current visa does not permit work, you will also need to demonstrate your relationship with an eligible spouse, de facto partner or other nominated family member as required.

This means we cannot make blanket statements such as “309 applicants have no Medicare before approval” or “Medicare is automatically available once you enter after lodgement”. Lawful residence, work rights and Medicare eligibility are assessed independently. Qualifying for healthcare coverage does not grant work rights or extend your visa.

  • How to choose the pathway? Clarify these four points first

1. Confirm whether a valid lodgement is possible now. Check your physical location, current visa, permitted stay duration and conditions such as 8503. Further assessment is required if you have prior refusals, visa cancellations, overstays, or currently hold only a bridging visa.

2. Decide where you will live during the waiting period. Are both parties able to accept temporary separation? Will you retain overseas employment? How will living costs be covered while waiting in Australia?

3. Review your work and travel requirements. Do you need to start working soon? Will you travel out of Australia frequently? These plans must comply with the conditions of whichever visa is active at the time.

4. Verify relationship evidence, sponsorship eligibility and supporting documents. Both pathways require thorough relationship evidence. You may organise materials around financial arrangements, household life, social recognition and long-term commitment, while checking sponsorship, health and character requirements.

When selecting your pathway, evaluate all these factors together rather than only comparing approval speeds from online case studies. Partner visas shape where you and your partner will live, work and reunite. Clarifying eligibility and waiting arrangements before lodgement makes your future plans more secure and reduces unnecessary delays. Always review your visa status first before picking the right pathway for you and your partner.
