Check Sponsorship History & Relationship Evidence Before Lodging a Partner Visa

When preparing an Australian partner visa, a marriage certificate or joint bank account is only part of the documentation. Applicants also need to verify sponsorship eligibility and use consistent evidence to prove a genuine, ongoing relationship, shared living arrangements and mutual commitment.

First, review past sponsorship and sponsored records. Partner sponsorship is generally subject to limits on the number of sponsored partners and a 5‑year time restriction. In general terms, if a person has already sponsored two different partners to obtain relevant visa approvals, sponsoring a new partner will require an exception. You should check past approval records, and whether the sponsor has previously been sponsored as a partner for a relevant visa. Withdrawn, refused and cancelled applications are not counted as the same scenario.

The 5‑year period usually starts from the lodgement date of the application that led to the relevant visa grant. It cannot be simply calculated from the date of divorce, visa grant or PR grant. This is a restriction on sponsorship approval and is assessed at the time the new sponsorship is approved; it should not be generalised as “a 5‑year gap is mandatory between two lodgements”. Legislation includes compelling circumstances exceptions for sponsors, which must be supported by specific facts and evidence.

Clearly explain timelines for quickly-developed relationships

Entering a new relationship shortly after divorce does not automatically mean the relationship is not genuine. When preparing documents, separate timelines should be set out for the end of the prior relationship, separation, legal divorce, as well as the date of meeting, commencement, cohabitation and marriage for the new relationship. These dates may differ, and explanations must align with objective records.

If applying as a married partner, confirm the marriage is valid under Australian law. If applying under a de facto relationship, prove the pair meets substantive de facto requirements, including exclusive mutual commitment to shared life. Ordinary dating duration cannot be directly treated as de facto relationship length.

De facto applications normally require evidence of at least 12 months of relationship prior to lodgement, subject to legislative exceptions such as a registered relationship that meets requirements. This does not mean everyone must live together continuously for 12 months; relationship registration does not remove the obligation to prove a genuine and ongoing relationship.

Same-sex partners are assessed under identical relationship criteria

Australian migration law recognises both same-sex and opposite-sex partnerships. Relationship assessment rules do not impose a higher evidentiary standard solely because the couple is same-sex. The conclusion that “same-sex partners are necessarily harder” is not correct.Where family, cultural or safety reasons limit public evidence or traditional proof of relationship, provide truthful explanations and compile materials reflecting actual shared life. This recommendation also applies to other couples with gaps in supporting evidence.

Evidence must reflect daily life and be cross-corroborated

Structure evidence around four areas: financial arrangements, household life, social engagement and mutual commitment. Examples include actual shared expenses, accommodation and household arrangements, joint activities, communications during periods apart and future plans. Documents must reflect genuine circumstances; do not fabricate contact records merely to satisfy formal requirements.

Before lodgement, cross-check partner statements, application forms, address records and statutory declarations from witnesses. If there is any history of prior sponsorship, refusals or cancelled applications, obtain a case assessment with full documents. Do not overlook other visa requirements based only on the belief that “the relationship is genuine”.
